SB 1383 Information and Resources

In September 2016, Governor Brown signed into law SB 1383, establishing methane emissions reduction targets in a statewide effort to reduce emissions of short-lived climate pollutants (SLCP) in various sectors of California's economy. SB 1383 establishes targets to achieve a 50 percent reduction in the level of the statewide disposal of organic waste from the 2014 level by 2020 and a 75 percent reduction by 2025.

What Does This Mean For...

Commercial Businesses: Those generating 2 cubic yards or more of commercial solid waste and 20 gallons or more of organic waste per week are required to divert organic materials. 

  • Food Waste - Currently, Republic Services offers food waste recycling services as an option for organics diversion. To implement a food waste recycling program, please contact their Customer Service team at (800)299-4898. 
    • Businesses that are able to donate surplus food are recommended to do so, through organizations such as Abound Food Care. Those that fall into Tier 1 or 2 "Commercial Edible Food Generator" are required. Please see the figure below, or visit CalRecycle's Food Donor page.

  • Green Waste - Businesses utilizing a landscaping company for green waste services need to inform the landscaping company of current State requirements and advise them to divert green waste from the landfill.

Multi-Family Residential Complexes: Complexes with 5 or more units are required to divert organic materials. At this time, only green waste diversion is required for compliance. 

  • Food Waste - At this time, there is no change to current bins and waste disposal process for Cudahy multi-family residents. The City of Cudahy is actively working with Republic Services to establish organics collection services. More information will be posted here when it becomes available. 
  • Green Waste - Multi-Family Residential Complexes utilizing a landscaping company for green waste services need to inform the landscaping company of current State requirements and advise them to divert green waste from the landfill. Details can 

Single-Family Residents: At this time, there is no change to current bins and waste disposal process for Cudahy multi-family residents. Eventually, food waste/scraps will be combined with the yard waste (brown) bin as a way of diverting food waste from the landfill. The City of Cudahy is actively working with Republic Services to establish organics collection services. More information will be posted here when it becomes available.  

Organics Implementation Timeline

July 1, 2020 - CalRecycle begins analyzing the progress that the waste sector, state governments, and local governments have made in regards to achieving organic waste reduction targets for 2020 and 2025. Upon conclusion of this analysis, CalRecycle may include incentives or additional requirements in the regulations to facilitate progress toward achieving the organic disposal reduction targets.

January 1, 2022 - CalRecycle’s regulations to meet the organic waste reduction targets for 2020 and 2025 take effect and are enforceable on this date

January 1, 2024 - CalRecycle may require local jurisdictions to impose penalties for non-compliance on regulated entities subject to their authority

January 1, 2025 - By this date, the state must achieve a 75% reduction in the level of statewide disposal of organic waste from the 2014 level. In addition, not less than 20 percent of currently disposed of edible food must be recovered for human consumption.
